JUSTICE SANJAY PRIYA ORAL ORDER 16-05-2018 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in Ghorasahan P.S. Case No. 191 of 2005 instituted for the offence under Sections-323, 448, 379, 376, 511 of the Indian Penal Code.
Counsel for the petitioner submits that there is general and omnibus allegation against this petitioner.
Learned APP has submitted that anticipatory bail of this petitioner was twice rejected by the court below. The anticipatory bail of this petitioner was rejected in the year, 2008 but the petitioner has not surrendered.
The report regarding present stage of the case has been called for from the court below, which has been received. In the report, it is mentioned that process under Sections-82 & 83 Cr.P.C against the petitioner has already been issued and the same has been executed on
Patna High Court Cr.Misc. No.16986 of 2018 (5) dt.16-05-2018 28-07-2017.
In such circumstances, this court is not inclined to grant anticipatory bail to the petitioner. Accordingly, prayer for anticipatory bail stands rejected.
The petitioner is directed to surrender in the court below and seek regular bail which will be considered and disposed of on its own merit in accordance with law without being prejudiced by this order. (Sanjay Priya, J) A.K.V./- U T
