JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-09-2019 This is an application for grant of anticipatory bail in connection with Maner P. S. Case No. 408 of 2018, disclosing offences under Sections 147, 148, 149, 341, 323, 307, 302, 379 of the Indian Penal Code and Section 27 of the Arms Act. As per prosecution case there is allegation of indiscriminate firing on the deceased and other and it further shows that deceased escape and further allegation is against Manoj Kumar and Vijay Kumar, who fired, causing injury to the deceased, due to which, he succumbed injuries. Submission of the learned counsel for the petitioner is that the F.I.R. itself shows that main allegation is against other co-accused persons and considering the same, several other accused persons have been granted privilege of anticipatory bail by the Co-ordinate Bench of this Court as well as by this Court,

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of Nutan Kumari, learned Judicial Magistrate, 1st Class, Danapur, Patna, in connection with Maner P. S. Case No. 408 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
