====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 10-10-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 126(2), 127(2), 115(2), 118(1), 118(2), 109, 303(2), 125 and 3(5) of the BNS, 2023.
3. Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and the informant alleges that Md. Pappu Qureshi and Md. Arif assaulted by butt of pistol thereafter Md. Pappu Qureshi assaulted the informant by knife causing injury near right eyebrow, further petitioner with rod and Md. Irshad along with Md. Abid with lathi assaulted, thereafter Md. Sabbir snatched Rs.2,75,30/- from the
Patna High Court CR. MISC. No.64644 of 2025(2) dt.10-10-2025 2/3 informant, further on alarm people gathered when accused fled away.
4. The learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is next submitted that from perusal of the allegation as alleged in the FIR, it would manifest that the informant alleges that he was assaulted by the named accused persons leading to injury, further Md. Pappu Qureshi is alleged to have assaulted by knife causing injury near right eyebrow, but then from perusal of the injury report, it would manifest that the informant suffered only one injury on the scalp by hard and blunt substance. It is thus submitted that had so many accused assaulted the informant, in that event the informant would have suffered multiple injuries, as such, the allegation does not inspire confidence.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
6. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/-
Patna High Court CR. MISC. No.64644 of 2025(2) dt.10-10-2025 3/3 (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Kazi Mohammadpur P.S. Case No. 137 of 2025, subject to the conditions as laid down under Section 482 (2) of BNSS.
7. Accordingly, the instant anticipatory bail application stands allowed.
