The petitioner seeks bail in a case registered under Sections 448, 506, 376/511 of the Indian Penal Code and Section-8 of thePOCSO Act.

The prosecution case, in short, is that in the night, the petitioner entered the house of the informant and attempted to commit rape upon the minor daughter of the informant. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 26-06-2019. Charge sheet in this case has already been submitted. The petitioner has been falsely implicated in the present case. The allegation, made

Patna High Court CR. MISC. No.66760 of 2019(2) dt.14-11-2019 2/2 in the FIR is denied by the petitioner. The name of the petitioner has figured in the present case due to village politics. It has further been submitted that the petitioner may be released after completion of six months in custody.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that after completion of six months in custody, the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-Ist-cum-Special Judge, POCSO Act, Patna in connection with Gaurichak P.S.
