Petitioners apprehend arrest in connection with Goh P.S. Case No.138 of 2017 registered for the offences under Sections 341, 323, 324, 379, 504, 307/34 of the Indian Penal Code. It has been submitted that the petitioners and the informant are agnates and an occurrence of assault took place on account of land dispute. In the said occurrence, both parties sustained injuries, which are simple in nature. For the said occurrence, a counter case has been lodged from the side of the petitioners.
Patna High Court Cr.Misc. No.20868 of 2018 (3) dt.03-05-2018 The learned A.P.P. for the State opposed the submission. Considering the facts and circumstances of the case, the prayer for anticipatory bail is allowed and the above named petitioners, in the event of arrest or surrender before the learned court below within six weeks from today, are directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the likewise amount each to the satisfaction of learned I/C Sub-Divisional Judicial Magistrate, Daudnagar, Aurangabad in connection with Goh P.S. Case No.138 of 2017 subject to the conditions as laid down under Section 438(2) of Cr.P.C.
