Petitioners apprehend arrest in connection with Imamganj P.S. Case No.162 of 2016 registered for the offences under Sections 147, 341, 342, 323, 504, 325, 379, 448 and 308 of the Indian Penal Code.
It appears that the petitioners and the informant are residents of same locality. The occurrence of assault took place on account of previous enmity. The sons of informant had teased the daughter of Ranjan Paswan (one of the co-accused) for which a police case bearing Mahila P.S. Case No.70 of 2016 has been
Patna High Court Cr.Misc. No.24943 of 2018 (3) dt.04-05-2018 lodged against the son and nephew of the informant of this case. The informant in order to save his son has lodged the present case with false and frivolous allegation. The allegation of assault against the petitioners is omnibus and they have clean antecedent. The learned A.P.P. for the State opposed the submission. Considering the facts and circumstances of the case, the prayer for anticipatory bail is allowed and the above named petitioners, in the event of arrest or surrender before the learned court below within six weeks from today, are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the likewise amount each to the satisfaction of learned A.C.J.M., Sherghati at Gaya in connection with Imamganj P.S. Case No.162 of 2016, subject to the conditions as laid down under Section 438(2) of Cr.P.C. (Sanjay Kumar, J) Harish/- U
