JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-06-2018 Petitioners apprehend their arrest in connection with Buniyadaganj P.S.Case No. 115 of 2012 registered for the offences punishable under Sections 341, 324, 307/34 of the Indian Penal Code and 27 of the Arms Act.

Allegation against the petitioners is that they came on motorcycle and petitioner No.2 has fired on the informant, causing injuries.

Submission of learned counsel for the petitioners is that there is no allegation against petitioner No.1 of any firing or assaulting the informant.

Heard learned APP and learned counsel for the informant, who has opposed the prayer for anticipatory bail stating that the case is of the year 2012 and petitioners are named in the

Patna High Court Cr.Misc. No.23443 of 2018 (4) dt.22-06-2018 2/2 FIR and prayer for anticipatory bail of one of the co-accused was rejected by this Court in Cr.Misc.No. 14976 of 2018 vide order dated 24.4.2018.and one of the injuries is grievous in nature. Having heard both sides and in the facts and circumstances, I am not inclined to grant privilege of anticipatory bail to the petitioners. They have to surrender and make prayer for regular bail, which shall be considered on its own merit, without being prejudiced by this order.
