The petitioner seeks bail in a case registered under Sections 413 & 414 of the Indian Penal Code and Section 25(1b)a/26/35 of the Arms Act. Allegedly, three live cartridges and a Pick up Van are recovered.

It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 05-03-2019. Charge sheet has already been submitted. Three live cartridges and a Pick up Van are alleged to have been recovered. The petitioner had no knowledge that the Pick up Van in question is a stolen property. There is no compliance of Section 100 Cr.P.C.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, West, Muzaffarpur in connection with Motipur P.S. Case No. 99 of 2019.
