====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 04-07-2023 Heard learned counsels for the petitioner and the State.

Petitioner apprehends arrest in case registered for the offences punishable under Sections 379 of the Indian Penal Code.

As per prosecution case, this petitioner took away motorcycle, mobile and cash of the informant. Learned counsel for the petitioner submits that the petitioner is innocent and he has been made accused on the basis of suspicion. No incriminating material has been recovered from the possession of the petitioner.

Learned counsel for the State opposes the prayer for bail application and submits that there is specific and direct allegation against the petitioner of stealing the motorcycle,

Patna High Court CR. MISC. No.70819 of 2022(5) dt.04-07-2023 2/2 mobile and cash from the informant and he has got two criminal antecedents.

Considering the nature of allegation and criminal antecedents, prayer for anticipatory bail of the petitioner is refused.
