2. Petitioner apprehends his arrest in a case registered for the offence punishable under sections 103, 191 (2), 191 (3) , 190, 126 ( 2 ) and 127 ( 2) of BNS.
3 . As per the prosecution case , informant namely, Ravishankar Kumar alleged that on 11.05.2025 , the elder brother of informant had gone to village Jarkha in his maternal uncle's house and on 12.05.2025 at about 03:00 PM, when he was returning from there, informant received a call from his maternal uncle that his elder brother had left the house but did not reach home and disappeared. Next morning on 13.05.2025 at about 05:00 AM, informant received information on phone from his maternal uncle that his elder brother has been
Patna High Court CR. MISC. No.65464 of 2025(3) dt.07-11-2025 2/3 murdered. When informant came to the village Hadinagar, he came to know that all the F.I.R. named accused persons along with 10 - 12 unknown persons brutally assaulted elder brother of informant by mean of lathi and danda due to which he died.
4. It is submitted on behalf of the petitioners that petitioner is innocent and has committed no offence as alleged. Informant is not an eye witness to the alleged occurrence . Only suspicion has been raised against this petitioner. As a matter of fact, informant does not disclose the name of villagers from whom he got information regarding the involvement of accused persons including this petitioner and 10 - 12 unknown persons who allegedly assaulted the deceased. Save and except suspicion , there is no other material available on record to show the complicity of this petitioner in the alleged occurrence . Petitioner claims clean antecedent.
5 . Learned counsel for the State as well as informant opposed the bail petition .
6 Considering the aforesaid facts, clean antecedent of the petitioner and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the
Patna High Court CR. MISC. No.65464 of 2025(3) dt.07-11-2025 3/3 like amount each to the satisfaction of the learned Judicial Magistrate - 1st Class, Danapur Patna in connection with Sigori P.S. Case No. 64 of 2025 , subject to the conditions laid down under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita , 2023 .
