JUSTICE SANJAY PRIYA ORAL ORDER 23-05-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Chandan P.S. Case No. 126 of 2016 instituted for the offence under Section-395 of the Indian Penal Code.

It has been submitted on behalf of the petitioner that petitioner is not named in the FIR and his name came in confessional statement of co-accused, Raju and Rinku. There is no recovery from possession of the petitioner. No TIP has been conducted by the police. The other co-accused have been granted bail by coordinate benches of this court vide orders dated 01-052017 & 09-05-2017 passed in Cr. Misc. Nos. 7521 of 2017 & 22170 of 2017.

In such circumstances, the prayer for bail is allowed and the petitioner named above, is directed to be released on bail

Patna High Court Cr.Misc. No.23719 of 2017 (2) dt.23-05-2017 2/2 on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Chandan P.S. Case No. 126 of 2016 to the satisfaction of Smt. Saroj Kirti, learned Judicial Magistrate-Ist Class, Banka subject to condition that both the bailors should be close relatives of the petitioner.
