This application, for grant of anticipatory bail, arises out of Complaint Case No. 728 (C)/2014, disclosing offences under Sections 420, 467 and 468 of the Indian Penal Code and Section 138 of the Negotiable Instruments Act. Allegation against the petitioner that he took Rs. 27,10,000/- for execution of sale deed in favour of complainant but he did not execute the sale deed and when he demanded his money back, he gave two cheques each of Rs. 2,00,000/- which was dishonoured by the Bank on presentation.

Considering the facts and circumstances of the case, this application is disposed of with direction to the petitioner to pay the amount of Rs. 4,00,000/- through Bank Draft to the complainant within a period of eight weeks and, thereafter, surrender in the court below and the court below after verifying that the amount of Rs. 4,00,000/- has been paid to the complainant, he shall release the petitioner on bail, otherwise he is free to pass any order as he deems fit and proper. For the period of eight weeks, let no coercive step be taken against the petitioner in connection with Complaint Case No. 728 (C)/2014.
