JUSTICE BIRENDRA KUMAR ORAL ORDER 03-05-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Section 394 of the Indian Penal Code and Section 27 of the Arms Act.

Name of the petitioner has transpired in the confessional statement of co-accused. The F.I.R. is against unknown.

Submission is that the petitioner was talking with co-accused on a mobile phone and on that basis he was roped in this case.

Considering the facts and circumstances, let petitioner, above named, be enlarged on bail on furnishing bail

Patna High Court Cr.Misc. No.21385 of 2017 (2) dt.03-05-2017 2/2 bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-II, Vaishali at Hajipur/Successor Court, in connection with Mahnar P.S. Case No.20 of 2017, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
