2. Application has been filed for modification of the order dated 09.08.2024, passed in Cr. Misc. No. 24248 of 2024, wherein while according the privilege of bail to the petitioner certain conditions inter alia, the verification of the criminal antecedent of the petitioner, has been imposed. It was made clear that at any stage, if it is found that the petitioner has concealed his criminal antecedent, the Court below shall take immediate step for cancelling the bail bond of the petitioner.

3. Learned Advocate for the petitioner contended that the wife of the petitioner is an illiterate lady and since her husband was in jail for the last four year, she was not knowing this fact that the petitioner had two other criminal antecedent

Patna High Court CR. MISC. No.71116 of 2024(2) dt.04-10-2024 2/2 besides the present one. Hence, the present modification application.

4. In view of the averments made in the modification application and taking into consideration the fact that the wife of the petitioner, who had sworn the affidavit is an illiterate lady, the order dated 09.08.2024 passed in Cr. Misc. No. 24248 of 2024 being modified to the extent that the petitioner carries two criminal antecedent, as has been mentioned in paragraph no. 5 of the modification application.

5. The present application stands disposed off accordingly.
