The petitioner seeks bail in a case registered under Sections 147, 148, 149, 307, 379, 385 of the Indian Penal Code. The prosecution case in short is that while the informant along with others was returning from Bishanpur, in the way, the accused persons surrounded him and assaulted the informant with Fasuli, as a result of which, he sustained injury. It is also alleged that Rs. 3000/- was snatched away from the pocket of one Subedar Yadav.

It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 19-06-2019. Charge

Patna High Court CR. MISC. No.60537 of 2019(2) dt.24-09-2019 2/2 sheet has already been submitted. The petitioner has been falsely implicated in the present case. Both parties are agnates. Due to property dispute, the present case has been instituted. The petitioner is said to have given single blow with the iron rod. The injury report indicates that the injury is caused by sharp cutting weapon. The allegation made in the FIR is not corroborated by the injury report.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Paraiya P.S. Case No. 66 of 2019.
