This application for grant of regular bail arises out of Sitamarhi P.S. Case No.369 of 2023 registered for the offence punishable under Section 30(a) of the Bihar Prohibition & Excise (Amendment) Act, 2018 and under section 21(b) of the N.D.P.S. Act.

The recovery is of 6.5 litres of country made liquor and 1.6 litres of cough syrup. The petitioners are in custody since 07.05.2023.

Considering the age of the petitioners, who
Patna High Court CR. MISC. No.71435 of 2023(2) dt.07-11-2023 2/2 are 78 and 68 years respectively and also considering their period of custody, this application is allowed. 5.
Let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Sessions Judge-cum-Special Judge (NDPS), Sitamarhi, in connection with Sitamarhi P.S. Case No.369 of 2023.

This is subject to the condition that petitioners shall mark their attendance in Sitamarhi Police Station, District-Sitamarhi, on every Sunday. Any default in appearance at the Police Station would result in cancellation of bail bonds of the petitioners.
