The petitioner is apprehending his arrest in connection with Katihar Nagar P.s.Case NO.733 of 2017 corresponding to G.R.No.4547 of 2017, registered for offences punishable under Sections 153, 153A, 307, 326 of the Indian Penal Code. Allegation against the petitioner as per FIR is that when the Tajiya procession was going on, six persons came on one motorcycle and one scooty and person who was sitting on the motorcycle fired on the procession and due to which two persons received injuries and the scooty of the petitioner was recovered from the place of occurrence.

Submission of the learned counsel for the petitioner is that he is not named in the FIR and some other

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant anticipatory bail to the petitioner rather let the petitioner surrender before the learned court below within a period of four weeks from the date of receipt of the order and make prayer for regular bail, which will be considered by the learned court below on its own merit without being prejudiced by the order of this Court.
