JUSTICE SANDEEP KUMAR ORAL ORDER 01-11-2023 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Budha Colony P.S.Case No. 544 of 2022 for the offence punishable under Section30(a) of the Bihar Prohibition & Excise Amendment Act.

It is alleged that 60 liters of illicit Chulai liquor was recovered from Rajendra Ghat.

Learned cousnel for the petitioner submits that nothing has been recovered from conscious possession of the petitioner. He is in custody since 15.06.2023. The petitioner has got four another criminal antecedent in which he is on bail in all the cases.

Learned APP has vehemently opposed the prayer of

Patna High Court CR. MISC. No.69514 of 2023(2) dt.01-11-2023 2/2 bail.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Excise Court , Patna in connection with Budha Colony P.S. Case No. 544 of 2022. The petitioner will visit Budha Colony police station on every Sunday of each month. Any default in appearance at the police station would be result in cancellation of bail bond of the petitioner.

Let a copy of this order be communicated to the Superintendent of Police, Patna for its compliance through FAX and e-mail forthwith.
