1. Heard learned Senior counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner has preferred this application for grant of anticipatory bail apprehending his arrest in connection with Madhepura (Bharrahi O.P.) P.S. Case no.399 of 2025 registered under sections 109, 126(2), 115(2), 118(1), 303(2), 352 and 3(5) of the Bharatiya Nyaya Sanhita, 2023.
3. As per the prosecution case, the informant states that having entered into a conspiracy the three named accused persons including the petitioner herein and 15-20 unknown persons came variously armed. It is stated that Ramesh Kumar Raman told his brother i.e. the petitioner herein that the fatherin-law of the informant should be caught on which the petitioner caught hold of him. It is further stated that Naresh Kumar
Patna High Court CR. MISC. No. 65317 of 2025(2) dt.17-09-2025 2/3 Raman took out Rs.4000/- from her father-in-law's pocket and thereafter Babita Kumari is said to have assaulted him with an axe causing injuries on his head.
4. Learned Senior counsel for the petitioner submits that the petitioner has been falsely implicated in the case. There is case and counter case between the parties. Even accepting the allegations levelled in the F.I.R., the allegation of assault is on Babita Kumari and not the petitioner herein. The petitioner has no criminal antecedent and undertakes to cooperate in the investigation/trial.
5. The application for anticipatory bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the allegations against the petitioner in the F.I.R., the allegation of assault on the father-in-law of the informant being on Babita Kumari and not the petitioner herein and the petitioner not having any criminal antecedent, in the facts of the case it is directed that the petitioner above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks, be released on anticipatory bail in connection with Madhepura (Bharrahi O.P.) P.S. Case no.399 of 2025 on furnishing bail bond of Rs.10,000/- (Rupees
