1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 126(2), 127(2), 115(2), 118(1), 117(2), 109, 352, 351(2) and 3(5) of the B.N.S., 2023.
3. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that on 04.04.2025 at around 7.00 A.M. all seven named accused persons were standing on the road in front of his house and were variously armed, further the accused persons surrounded the informant and started demanding the tractor of informant's uncle as extortion, on protest, Prabhu gave order to kill the informant's uncle, on which, Pappu, Ramesh and

No.66854 of 2025(3) dt.19-11-2025 2/3 petitioner caught him and Sunil assaulted, thereafter all the accused persons assaulted the informant, it is next alleged that Prabhu assaulted by an iron rod causing fracture of left hand of the informant and when informant's nephew came to rescue him, Prabhu caught him and assaulted by an iron rod causing injury on head, thereafter on hearing alarm, informant's uncle came to save them then accused persons also assaulted him and petitioner started waving gun with an intention to kill.
4. Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is next submitted that petitioner and the informant are agnates and are having dispute relating to land but then informant for reasons best known has tried to make out a case of extortion. It is also submitted that as far as petitioner is concerned, the allegation against him is general and omnibus in nature and allegation of carrying gun is ornamental and FIR has not been instituted under the Arms Act.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
6. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below
Patna High Court CR. MISC. No.66854 of 2025(3) dt.19-11-2025 3/3 within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Sri Nagar P.S. Case No.94/2025, subject to the conditions as laid down under Section 482(2) B.N.S.S.
