2. The petitioner is in custody in connection with Nayagaon P.S. Case No. 05 of 2024 registered for an offence punishable under Sections 341, 323, 324, 325, 307, 504 and 506/34 of the Indian Penal Code.
3. As per prosecution case, 10-12 unknown persons came at the house of the informant and started installing the pillars to block the way and when the informant objected it, all the accused persons started assaulting and abusing him.
4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case due to land dispute between the parties. He next submits that there is no specific allegation attributed against the petitioner and the
Patna High Court CR. MISC. No.70568 of 2024(2) dt.31-01-2025 2/2 allegations are general and omnibus. Petitioner is in custody since 21.07.2024.
5. Learned APP for the State opposes the prayer for bail of the petitioner.
6. From perusal of the first information report and impugned order dated 21.08.2024, it appears that there is no allegation of repeated blow against the petitioner rather he has been made accused only on the basis of land dispute attributed between the parties and also the submissions as made by the petitioner that similarly situated co-accused persons namely Girdhar Kumar and Rohit Kumar have been granted bail by this Court in Cr. Misc. No. 16273 of 2024 vide order dated 15.03.2024, in this circumstances, I am inclined to grant bail to the petitioner. Accordingly, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st, Class, Begusarai in connection with Nayagaon P.S.
