The present petition has been filed for grant of regular bail on behalf of the petitioner in connection with Special (POCSO) Case No. 448 of 2019 registered for the offence punishable under Sections 341, 323, 325, 354(B), 504/34 of the Indian Penal Code.

The allegation is regarding the accused persons including the petitioner herein having tried to molest the grand daughter of the informant and thereafter are said to have assaulted the victim girl.

The learned counsel for the petitioner submits that the present case arises out of case and counter case, the counter case being Masaurhi P.S. Case No. 449 of 2019 which was lodged on

Patna High Court CR. MISC. No.60705 of 2019(3) dt.20-11-2019 2/2 the same date by the petitioner herein. It is further submitted that the present case has been filed on account of dispute over a passage in between the house of both the sides. The petitioner is stated to be having a clean antecedent and he is languishing in custody since 15.06.2019.

Having regard to the facts and circumstances of the present case, this Court deems it fit and proper to grant regular bail to the petitioner, above named, on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand), with two sureties of the like amount each to the satisfaction of learned A.D.J.-1-cum-Special Judge, POCSO, Patna in connection with Special (POCSO) Case No. 108 of 2019 arising out of Masaurhi P.S. Case No. 448 of 2019.
