JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 16-12-2022 At the outset, learned counsel for the petitioners seeks permission to withdraw anticipatory bail petition with respect to petitioner No. 1, Akhilesh Singh.

Permission is granted.

The anticipatory bail petition with respect to petitioner No. 1, Akhilesh Singh, is dismissed as withdrawn. Heard learned counsels for petitioner No. 2 and the State.

Petitioner apprehends arrest in a case registered for the offence punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2018.

As per prosecution case, 20 litres country made liquor

Patna High Court CR. MISC. No.65386 of 2022(2) dt.16-12-2022 2/2 has been recovered from behind the house of Akhilesh Singh. Learned Counsel for the petitioner submits that the petitioner has falsely been implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioner and he is in no way connected with the aforesaid recovery. Petitioner has got no criminal antecedent.

Considering the aforesaid facts and circumstances, let the above named petitioner in the event of his arrest/surrender before the court below within a period of thirty days from the date of receipt/production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Exclusive Special Excise Court-II, Saran at Chapra in Marhowrah P. S. Case No. 543 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
