The petitioner seeks bail in Nawkothi P. S. Case No. 54 of 2019 instituted for the offence under Section(s) 25(1-AA), 25(1-b)a/26/35 of the Arms Act.

On secret information, the police have gone to the place from where the petitioner was arrested. The apprehension was that some antisocial elements have assembled for commission of an offence. The allegation is of recovery of country made pistol and 11 live cartridges from the petitioner's possession. It is submitted by the petitioner's counsel that the petitioner has falsely been implicated in the instant case. The petitioner is in custody since 17.05.2019 and it is submitted that

Patna High Court CR. MISC. No.74031 of 2019(2) dt.11-12-2019 2/2 he is on bail in other two cases pending against him, which are in relation to some land dispute of his village. Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate 1st Class, Begusarai, in connection with Nawkothi P. S. Case No. 54 of 2019 , subject to the following conditions:- (i) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.

(ii) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail bond will be liable to be cancelled.
