Petitioner apprehends his arrest in Imamganj P.S. Case No. 206 of 2017 instituted for the offence under Sections 420, 467, 478, 471 and 409 of the Indian Penal Code. It is alleged in the written report that in terms of order of this Hon'ble Court, certificate of this petitioner was verified who was appointed as Shiksha Mitra in Primary School, Rampur Prakhand Imamganj and during the verification it was found that mark-sheet of UP Shastri issued by Kameshwar Singh Darbhanga Sanskrit Vishwa Vidhyalaya was fake. Learned counsel for the petitioner submits that he was discharging his duty as Panchayat Teacher since 11.05.2005. His mark-sheet of UP Shashtri was never found forged as he has no

No.9029 of 2018(5) dt.26-06-2018 2/3 knowledge about the aforesaid fact that his mark-sheet of UP Shashtri was forged since the same was issued by the Kameshwar Singh Darbhanga Sanskrit University and for this Authority of University is responsible. It is further submitted that after lodging of this case the appointment of the petitioner has been cancelled vide letter dated 12.03.2018. He has filed the xerox copy of the aforesaid letter during hearing of the case. In the facts and circumstances of the case, prayer of the petitioner for grant of anticipatory bail is allowed. In the event of surrender/arrest of the petitioner, named above, within six weeks from today in connection with Imamganj P.S. Case No. 206 of 2017 he shall be released on anticipatory bail on furnishing bail bond of Rs.
10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M., Sherghati, District Gaya, subject to the conditions as laid down under Section 438(2) Cr. P. C.
Patna High Court Cr.Misc. No.9029 of 2018(5) dt.26-06-2018 3/3 petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner.
The authority is at liberty to take appropriate action for recovery of the money which has been paid to the petitioner while he was working as Panchayat Teacher on the basis of aforesaid forged certificate.
