2. The petitioners apprehend their arrest in connection with Kundwa Chainpur P.S. Case No. 193 of 2025 dated 12.07.2025 registered under Section 317(5) of BNS and Sections 30(a), 32 and 41(1) of the Bihar Prohibition and Excise Amendment Act.

3. As per the first information report, while a police team was on patrol, it saw two motorcycles loaded with bags coming, however, on seeing the police party, the motorcyclists tried to flee away after throwing the bag. On chase, the police caught one accused, who, during interrogation, disclosed the name of other accused. 378 liters of illegal Nepali liquor was recovered from the said bag and the motorcycles and the liquor

Patna High Court CR. MISC. No.66025 of 2025(2) dt.24-09-2025 2/2 were seized.

Learned counsel for the petitioners submits that neither the seized article nor the motorcycles, from which country made liquor is said to have been seized, belong to the petitioners, who have no criminal antecedents. Their names surfaced in this case on the statement of co-accused Raj Kishore Pawan.

5. In view of the fact that the petitioners have no criminal antecedents and they have not been apprehended with the illicit liquor, I am inclined to grant anticipatory bail to the petitioners.

6. Let the petitioners, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge. Excise Court-3, East Champaran, Motihari, in connection with Kundwa Chainpur P.S. Case No. 193 of 2025 subject to the conditions as laid down under Section 482 (2) of the B.N.S.S., 2023.
