JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-03-2020 The petitioner seeks regular bail in connection with Narkatiaganj Rail P.S. Case No. 42 of 2019, registered for offences punishable under Sections 302, 201 and 34 of the Indian Penal Code.
Prosecution case is that the brother of the informant, who was of dull mind, left the house on 04.05.2019 and later on his dead body was recovered on 05.05.2019. It appears that petitioner is not named in the F.I.R. later on his name transpired on the confessional statement as one of the persons, who has assaulted the brother of informant considering him thief. It has been submitted on behalf of the petitioner that save and except confessional statement, there is absolutely nothing against the petitioner. Further he has no criminal

Having heard both sides, in view of the above submission, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate (Railway), Narkatiaganj, Bettiah, West Champaran, in connection with Narkatiaganj Rail P.S. Case No. 42 of 2019, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
