This application has been filed on behalf of the petitioner for modification of the order dated 17.02.2018 passed in Criminal Misc. No.8773 of 2018 by this Court.
Learned counsel for the petitioner submits that due to typing error, in the prayer portion of Criminal Misc. No.8773 of 2018, the name of the court concerned has been typed as "Sessions Judge, Bhagalpur" in place of "Chief Judicial Magistrate, Banka" and due to that reason, in the order dated 17.02.2018 passed in Criminal Misc. No.8773 of 2018, whereby the petitioner has been granted anticipatory bail, the name of the court concerned has been typed as "Sessions Judge, Bhagalpur, in place of "Chief Judicial Magistrate, Banka", and, therefore, learned counsel for the petitioner prays for modification in
Patna High Court Cr.Misc. No.12508 of 2018 (2) dt.14-03-2018 2/2 the order dated 17.02.2018 passed in Criminal Misc. No.8773 of 2018 by this Court with regard to the same. A prayer has also been made to extend the period of surrender of the petitioner in the court below in connection with the concerned case.
Let in the order dated 17.02.2018 passed in Criminal Misc. No.8773 of 2018 by this Court, the name of the court concerned be read as "Chief Judicial Magistrate, Banka" in place of "Sessions Judge, Bhagalpur". The date of surrender of the petitioner in the court below in connection with the concerned case is further extended for a period of four weeks from today.
With the aforesaid modification in the order dated 17.02.2018 passed in Criminal Misc. No.8773 of 2018 by this Court, this application is disposed of.
Let this order and the order dated 17.02.2018 passed in Criminal Misc. No.8773 of 2018 by this Court be communicated to the court of the Chief Judicial Magistrate, Banka, in connection with Chandan P.S. Case No.45 of 2017 through FAX at the cost of the petitioner.
