2. The petitioner seeks bail in a case, registered for the offence punishable under Sections 126(2), 115(2), 109(1), 352, 303(2), 103 and 3(5) of the Bharatiya Nyaya Sanhita, 2023.
3. Prosecution case in brief is that all the FIR named accused persons including petitioner and 10-12 unknown persons armed with sticks and iron rods came at the door of informant and started abusing and beating him. When the informant's son came out of house, co-accused Bachcha Sah ordered to kill , then Jai Kumar Sah hit the informant's son on his head with iron rod. Petitioner is alleged to have took away gold chain and nose pin of the informant's wife.
4. Learned counsel for the petitioner submits that
Patna High Court CR. MISC. No.65244 of 2025(3) dt.11-11-2025 2/2 specific accusation of assault is against co-accused Jai Kumar Sah. Petitioner is only alleged to have committed theft of jewellery. There is no specific allegation of assault against this petitioner. Chargesheet has already been submitted. Petitioner claims clean antecedent and she is in custody since 13.06.2025.
5. Learned APP and learned counsel for the informant vehemently oppose the prayer for bail of the petitioner.
6. Considering the aforesaid facts, let the petitioner above-named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Bettiah, West Champaran in connection with Sanichari P.S. Case No. 69 of 2025.
