JUSTICE ASHUTOSH KUMAR ORAL ORDER 28-06-2018 The petitioner seeks bail in anticipation of his arrest in connection with Jehanabad P.S. Case No. 687 of 2017, dated 15.10.2017, instituted for the offences punishable under Sections 467, 468, 474, 420 and 120B of the Indian Penal Code and Section 66(B)(C) of the Information Technology Act.

The informant, who is a police officer, has alleged that large scale bungling in the examination for recruitment for the post of Constables was being done by the accused persons by using electronic device.

It has been submitted on behalf of the petitioner

Patna High Court Cr.Misc. No.19677 of 2018 (3) dt.28-06-2018 2/2 that he has been made accused in this case on the basis of recovery of a certificate in his name from the possession of one Vishal Kumar @ Mukaddar. Beyond this, there is no allegation against the petitioner. It has further been submitted that under similar circumstance, other accused persons have been granted anticipatory bail by different Benches of this Court.

Considering the aforesaid facts as also taking into account that the petitioner was not arrested from the spot and nothing was recovered from his possession, this application is allowed.

Let the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jehanabad in connection with Jehananbad P.S.
