2. The dispute between the parties is of possession. It has been submitted by learned counsel for the petitioner that at the time of proceedings of demarcation case, the petitioner has been dispossessed whereas learned counsel for the private respondents submits that the respondents were in possession. This disputed question of fact cannot be decided by this Court.
3. The District Magistrate, Rohtas at Sasaram is directed to conduct an enquiry and decide as to who are in possession and whether there has been any forcible dispossession of the petitioner by the respondents or the respondents were already in possession.
4. This application is disposed of.
