Petitioner apprehends arrest in a case registered for the offences punishable under Sections 420, 468/34 and other allied sections of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per prosecution case, 3585.280 litres foreign liquor has been recovered from truck and pick-up van. Learned Counsel for the petitioner submits that the petitioner has falsely been implicated in this case. Petitioner has been made accused only because the motorcycle of the petitioner was found near the place of recovery. No incriminating material has been recovered from the conscious possession of the petitioner. Petitioner has clean antecedent.

No.65428 of 2022(2) dt.16-12-2022 2/2 Considering the aforesaid facts and circumstances, let the above named petitioner in the event of his arrest/surrender before the court below within a period of thirty days from the date of receipt/production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of 2nd Special (Excise), Darbhanga in Moro P. S. Case No. 13 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
