The petitioner is in custody in connection with Goraul P.S. Case No. 239 of 2014 for the offences under Sections 399, 402 of the Indian Penal Code and Section 25(1-B)a, 26/35 of Arms Act.
Learned counsel for the petitioner submits that the present case is a celebrated example of failure of Institutional care in reforms of Juvenile. Instead of parental care petitioner was sent for Institutional care for correction but instead of any reform he joined the company of offenders. In the instant case he was made accused for offence under Sections 399, 402 of the Indian Penal Code and Section 25(1-B)a, 26/35 of Arms Act. He was arrested in this case on 26.08.2014 and thereafter, he was
Patna High Court CR. MISC. No.63490 of 2019(2) dt.17-10-2019 2/2 remanded. He has remain in custody for two years seven months and fifteen days and than he fled away from remand room. He was again apprehended on 25.06.2019 and since than he is in custody.
Considering the totality facts situation, the Court is inclined to grant bail to the petitioner, let the petitioner, named above, be released on bail on furnishing bail bonds of Rs.25000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Court of learned SubDivisional Judicial Magistrate, Vaishali at Hajipur in connection with Goraul P.S. Case No. 239 of 2014, subject to condition that the bailor should be the parents. The court hope and trust that parental care will prove catalyst to change the behavior of this petitioner and may prove to be turning factor in reforming the petitioner and restoration of the petitioner in main stream of the society.
