Petitioner apprehends his arrest in connection with Chapra Muffasil P.S. Case No. 401 of 2017, registered for the offences punishable under Sections 406 and 420 of the Indian Penal Code.
Petitioner is driver of informant and as per FIR allegation against the petitioner is that he concealed the truck of the petitioner somewhere else and not producing the same. Submission of learned counsel for the petitioner is that salary of the petitioner was due with the informant and when he demanded the same he has falsely been implicated in this case. Heard learned APP also, who has opposed the prayer for anticipatory bail stating that the truck is still traceless.
Patna High Court Cr.Misc. No.15083 of 2018 (4) dt.09-05-2018 2/2 Having heard both sides and in the facts and circumstances, I am not inclined to grant privilege of anticipatory bail to the petitioner, rather petitioner to surrender and pray for regular bail, which shall be considered on its own merit. With the above observation, this application is dismissed. (Vinod Kumar Sinha, J) spal/- U
