This appeal has been preferred against refusal of prayer for anticipatory bail in connection with Ghorasahan P.S.Case No.426 of 2017.
Submission is that the appellant and others have challenged the FIR of the aforesaid case in Cr.W.J.C.No.1733 of 2017 and by order dated 18.10.2017, order for no coercive step against the writ petitioners has been passed vide Annexure-7.
In the circumstances, the appellant be permitted to withdraw this appeal with liberty to move the learned court below afresh for anticipatory bail, if the occasion so arises in future.
Prayer is allowed.
Accordingly, this appeal is dismissed as withdrawn with aforesaid liberty.
