Heard learned counsel for the petitioners and learned counsel for the State.

Petitioners apprehend arrest in connection with Bairiya P.S. Case No. 207 of 2023 registered for the offences under Sections 341, 323, 324, 354, 504, 506 and 34 of the Indian Penal Code.

Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in the instant case due to land dispute. Further submission is that the allegation on the petitioners of assaulting the mother of the informant namely Umarawati Devi is fabricated as no visible injury is found in the medical report contained at Annexure-P/3.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, the petitioners, above named are directed to be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bonds of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of Additional District and Sessions Judge-VII'th-cum-Special Judge POCSO, Bettiah, West Champaran in connection with Bairiya P.S. Case No. 207 of 2023, subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
