The petitioner seeks bail in connection with Motihari Town P.S. Case No. 406 of 2019, registered for the offence punishable under Sections 413, 414 and 34 of the Indian Penal Code.
Learned counsel appearing on behalf of the petitioner submits that the petitioner is innocent and has implicated on the basis of suspicion. Further submission is that incriminating material has not been recovered from the possession of the petitioner. The petitioner is in custody since 18.06.2019. Learned A.P.P. appearing for the State submits that the petitioner was apprehended with the stolen motorcycle which suggests his complicity in the alleged crime.
Patna High Court CR. MISC. No.63020 of 2019(2) dt.24-10-2019 2/2 Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, I am not inclined to grant bail to the petitioner.
Accordingly, this application is rejected with liberty to the petitioner that he may renew his prayer for bail after framing of charge.
