Petitioner apprehends his arrest in Certificate Case no. 02 of 2016-17 before the Nilam Certificate Officer, Siwan. It is alleged that this petitioner was appointed as Teacher at Prathamik Vidhyalya Bakulari, Anchal- Guthni. It was found during investigation that his documents were forged and he was dismissed from service vide order dated 27.5.10 by order of District Education Superintendent, Siwan. Thereafter, the process of recovery of amount paid to the petitioner as salary was initiated and it was found that he had received an amount of Rs. 12,99,909/- while he was appointed on the basis of the forged document. The certificate proceeding was initiated

Patna High Court Cr.Misc. No.24018 of 2018(5) dt.27-06-2018 2/2 against this petitioner for recovery of the aforesaid amount and certificate has been issued for recovery of Rs. 12,99,909/- from the petitioner vide Annexure- P/1 by order dated 15.12.2016. In such circumstances, this Court finds that certificate has already been issued against this petitioner for recovery of the amount. Therefore, no anticipatory bail petition is maintainable. Prayer for anticipatory bail of the petitioner stands rejected. Petitioner may surrender before the Court below and make prayer for regular bail which shall be considered and disposed of on its own merit in accordance with law without being prejudiced by the present order.
