The petitioner seeks bail in connection with Cyber P.S. Case No. 344 of 2024 instituted for the offence under Sections 303(2), 318(4) & 319(4) of the Bharatiya Nyaya Sanhita, 2023 and Sections 66(c) & 66(d) of the Information Technology Act, 200.

The prosecution case, in brief, is that an FIR was lodged by Vikash Kumar, alleging that he was defrauded of Rs. 45,86,000/- by an unknown person impersonating a Crime Branch officer, who coerced him into transferring the amount under the pretext of a Supreme Court investigation and RBI verification.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 19-07-2025. Petitioner bears no criminal antecedent, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. The petitioner is not named in the FIR and his name has surfaced only during investigation due to a bank transaction. The only transaction attributed to the petitioner is the receipt of Rs. 2,10,011/- in his Canara Bank account from one Dinesh Bishnoi, which the prosecution alleges is part of the defrauded amount. In this connection, it is strenuously submitted that aforesaid amount is a bona fide transfer made by his hostel roommate in Jodhpur on the pretext that his own account was not functioning. It is lastly submitted that petitioner was not aware of the alleged occurrence and he has become the victim of the circumstance. Other co-accused has been granted bail by this Court vide order dated 01-05-2025, passed in Cr. Misc. No. 14131 of 2025.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. 7.

Considering the aforesaid facts and circumstances

Patna High Court CR. MISC. No.65751 of 2025(2) dt.17-09-2025 3/3 of the case, period of custody of the petitioner, claim based on parity and manner of petitioner's implication, this Court is inclined to grant bail to the petitioner.

Let the petitioner be released on bail on furnishing bail bonds of Rs. 15,000/- (Fifteen Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Cyber P.S. Case No. 344 of 2024.
