ANJANA MISHRA ORAL ORDER 04-11-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 09.06.2019 in connection with Ballia P.S. Case No.192 of 2019 registered for the offence under Section 302/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R., but subsequently on the basis of some police spy, the name of one Mithun Paswan was disclosed and in the statement made before the police by the said Mithun Paswan, the names of the present petitioner, Amala Devi and Md. Shabir have come and that the petitioner is being prosecuted in connection with the present case. Learned counsel for the petitioner submits that a similarly

Patna High Court CR. MISC. No.61154 of 2019(2) dt.04-11-2019 2/2 situated co-accused, namely, Md. Sabir @ Md. Sabbir has also been extended the privilege of bail in Cr. Misc. No.59413 of 2019, vide order dated 27.09.2019. The case of Md. Sabir and the petitioner stands identical to the same.

In view of the aforementioned facts and circumstances and also because the petitioner is not having any criminal antecedents, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai, in connection with Ballia P.S. Case No.192 of 2019.
