The petitioner seeks bail in a case registered under Section 379 of the Indian Penal Code.
Allegation is that unknown miscreant committed theft of motorcycle of the informant.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 6.8.2019 and has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. The petitioner had no knowledge that the motorcycle in question is stolen property. He has been made accused due to mistake of fact. He has not been put on T.I.P. Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Darbhanga in connection with Kamtaul P.S. case No.112 of 2019.
