The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 420, 484, 471, 469, 353, 500/34 of the Indian Penal Code and Section 79 of the I.T. Act.

The prosecution case is that the petitioner along with co-accused persons viraled some dirty and objectionable subject against the informant for defame him who is police personnel and there is allegation of money extortion against this petitioner. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He submits that there is no specific overt act against the petitioner. There is specific allegation against one Tanveer Alam who came near the informant and demanded the illegal money

Patna High Court CR. MISC. No.65516 of 2022(2) dt.24-02-2023 2/2 from him on account of non-viral of the news. He submits that there is general and omnibus allegation levelled against the petitioner. He further submits that petitioner has no criminal antecedent as stated in para-3 of this application. Learned APP for the State opposes the prayer for bail and submits that the petitioner made obstruction in discharging the government duty. He further submits that the occurrence has been supported by the informant as well as witnesses during the investigation.

Considering the facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for anticipatory bail is rejected in connection with Korha P.S. Case No. 555 of 2021. (Anjani Kumar Sharan, J) Trivedi/- U T
