JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-06-2018 Petitioner apprehends his arrest in connection with N.D.P.S. Case No. 32 of 2017, arising out of Jagdishpur P.S. Case No. 263 of 2017 registered for the offences punishable under Sections 21, 22 and 24 of the N.D.P.S. Act.

Allegation is of recovery of 575.295 kg. of ganja and petitioner is not named in the FIR but later on his name transpires during course of investigation.

Submission of learned counsel for the petitioner is that except confessional statement there is absolutely nothing against the petitioner.

Having heard both sides and in view of recovery of huge quantity of ganja and co-accused has named this petitioner, I am

Patna High Court Cr.Misc. No.23293 of 2018 (5) dt.25-06-2018 2/2 not inclined to grant privilege of anticipatory bail to the petitioner, rather petitioner to surrender and make prayer for regular bail, which shall be considered ion its own merit.
