The petitioner is apprehending his arrest in connection with Hajipur Sadar P.S.Case no.519 of 2017 registered for offences punishable under Sections 341, 342, 302 and 120B of the Indian Penal Code and Section 27 of the Arms Act.

Petitioner is not named in the FIR and there is allegation against the petitioner of firing.

Submission of the learned counsel for the petitioner is that the informant is not eye witness and the petitioner has been falsely implicated in this case. He is brother of the main accused. Heard learned A.P.P. also, who has opposed the prayer for bail.

Having heard both sides and in view of the facts and

No.23590 of 2018 (4) dt.18-06-2018 2/2 circumstances, as stated above, I am not inclined to grant anticipatory bail to the petitioner rather let the petitioner surrender before the learned court below within a period of four weeks from the date of receipt of the order and make prayer for regular bail, which will be considered by the learned court below on its own merit without being prejudiced by the order of this Court.
