JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-07-2018 Petitioners apprehend their arrest in connection with Jogbani (Bathnaha) P.S.Case No. 70 of 2014 registered for the offences punishable under Sections 364/34, 302, 201, 120B and 34 of the Indian Penal Code.

Allegation as per FIR is that informant got an information that blood was coming out of the house and he found that his sister and husband of sister, who were in the house, were missing and thereafter dead body was recovered and there was dispute between brother and brother-in-law from before and a case has also been lodged and two petitioners were named in the FIR. Submission of learned counsel for the petitioners is that there is absolutely nothing against the petitioners and after investigation they were not sent up for trial but learned Magistrate

Patna High Court Cr.Misc. No.18971 of 2018 (3) dt.05-07-2018 2/2 has taken cognizance against them.

Heard learned APP also.

Having heard both sides and in the facts and circumstances, as stated above, let the petitioners, above named, in the event of their arrest or surrender be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Araria, in connection with Jogbani (Bathnaha) P.S.Case No. 70 of 2014, subject to the conditions as laid down under Sectiion 438(2) of the Code of Criminal Procedure and further condition is that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
