JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-06-2018 Petitioner apprehends her arrest in connection with Ahiyapur P.S.Case No. 730 of 2015 registered for the offences punishable under Sections 406, 419, 420, 467, 468, 471, 341, 323, 504 and 120B of the Indian Penal Code.
Allegation against the petitioner is that she along with other accused persons has opened a company in the name of Maahalaya Company and informant and other depositors have deposited money with the Company and now the Company is not returning the money.
Submission of learned counsel for the petitioner is that as a matter of fact the main accused is Alok Kumar Srivastava, who is Managing Director of the Company, and the petitioner happens to be his wife and there is no allegation against her.

Having heard both sides and in the facts and circumstances, let the petitioner, named above, in the event of her arrest or surrender be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-XII, Muzaffarpur, in connection with Ahiyapur P.S.Case No. 730 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further conditions are that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned and petitioner has to co-operate in the investigation and appear before the Investigating Officer as and when required, otherwise her bail bond shall be cancelled.
