JUSTICE SANJAY PRIYA ORAL ORDER 17-05-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Nanpur P.S. Case No. 21 of 2017 instituted for the offence under Sections 363 and 366(A)/34 of the Indian Penal Code.
As per written report, the minor daughter of the informant has been kidnapped by this petitioner and his other family members. It is alleged that this petitioner used to tease the daughter of the informant earlier also.
The victim girl has given her statement under Section 164 Cr. P.C. which is annexed as Annexure-2 wherein she has not taken the name of this petitioner. The victim girl has stated her age as 14 years whereas the Magistrate has assessed her age as 16 years.
Patna High Court Cr.Misc. No.22801 of 2017 (2) dt.17-05-2017 2/2 Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Pupri at Sitamarhi, in connection with Nanpur P.S.
