2. The petitioner has preferred this application for grant of regular bail in connection with Chewara P.S. Case No. 09/2025 dated 23.02.2025 registered for the offences punishable u/ss 109(1), 132 read with section 3(5) of the BNS and sections 25(1-B) (a), 26, 27 and 35 of the Arms Act.

As per the prosecution case, the informant got an information that the wanted accused of Matihani P.S. case No. 167/2024 Golu Kumar @ Golu Singh, over whom government has declared a reward of Rs. 50,000/- in case of his arrest, along with his 3-4 associates was hiding himself in village- Ekaraha,
Patna High Court CR. MISC. No.64919 of 2025(2) dt.13-10-2025 2/3 P.S.- Chewara. On information, when the informant along with the police team reached near the garden of Karu Singh, they saw that three people were present there and one of whom were identified by the raiding team as Golu Singh @ Golu Kumar (petitioner). When the accused persons were told to surrender, they opened fired on the police team. On repeated warning to surrender, the accused persons continued firing on the raiding team, then in self-defence the police team had fired from their official weapon on the accused persons. Out of the three accused persons, two accused succeeded to escape. However, one of them was found lying near ground of High School. There was a loaded pistol in his right hand and he had a bullet injury in the right leg. On asking his name he told his name as Golu Kumar @ Golu Singh (petitioner). From the magazine of pistol six live cartridges were recovered and an empty cartridge was found stuck in the chamber of pistol.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The allegation against the petitioner is of firing on the police team but he was apprehended in injured condition of bullet injury with the loaded pistol. The petitioner has not even fired a single bullet from the pistol. No any police personnel sustained any injury. Nothing has been recovered from the
Patna High Court CR. MISC. No.64919 of 2025(2) dt.13-10-2025 3/3 conscious possession of the petitioner. The petitioner has 17 criminal antecedents as stated in para 3 of the bail petition. The petitioner is in custody since 11.03.2025.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner by submitting that the petitioner is a notorious criminal.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Sheikhpura in connection with Chewara P.S. Case No. 09/2025, with the condition/s:- (i). The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled.
