The petitioner seeks bail in connection with a case registered for the offence punishable u/s 147, 148, 149, 307, 354, 341, 323, 379, 427, 504, 506 of the IPC to which Sec 302 of IPC and 27 of Arms Act were added subsequently. 3.
Allegedly, the petitioners along with other co-accused persons surrounded the informant and assaulted the informant and his brother due to which the brother of informant succumbed to the injuries.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has not committed any offence as alleged in the FIR. No offence as alleged has ever took place.
Patna High Court CR. MISC. No.69402 of 2024(3) dt.13-12-2024 2/2 He has been falsely implicated in this case. The allegation leveled against the petitioner is general and omnibus in nature. There is no specific overt act attributed against the petitioner. The specific allegation of firing is against co-accused, Satyendra Yadav. Other co-accused persons have been granted anticipatory bail by this court. The petitioner has one criminal antecedent as mentioned in para 3 of the bail application and has been languishing in custody since 26.05.2024.

Learned APP for the State and learned counsel for the informant opposed the prayer for bail.

Considering the facts and circumstances of this case, period of custody of the petitioner and the fact that there is no specific overt act attributed against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/the Successor Court, in connection with Goshi P.S.
