JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-06-2018 Petitioner apprehends his arrest in connection with Bhagwanpur P.S.Case No. 14 of 2018 registered for the offences punishable under Sections 420, 406, 409 and 120B of the Indian Penal Code.
Allegation against the petitioner, who happens to be subPost Master, is that he in collusion with others transferred an amount of Rs.92 lakhs and odd in the account of other accused persons and thereby misappropriated the same. Submission of learned counsel for the petitioner is that the petitioner was not competent enough to do so, rather he supplied his code to other person, who has done the same and earlier also Rs.34 lakhs was transferred to other account but the
Patna High Court Cr.Misc. No.17700 of 2018 (3) dt.20-06-2018 2/2 amount had already been deposited by the petitioner. Heard learned APP also.
Having heard both sides and in the facts and circumstances, I am not inclined to grant privilege of anticipatory bail to the petitioner. Petitioner to surrender and make prayer for regular bail, which shall be considered on its own merit, without being prejudiced by this order.
